
A master's thesis at the College of Law at the University of Basrah discussed the role of the administrative judiciary in settling industrial property disputes.
The thesis presented by the researcher Alaa Hassan Khudair showed that the control of the administrative judiciary represents an important role in the field of monitoring administrative decisions related to industrial rights, as it is the most important guarantee that achieves balance between the administrative authority represented by the Registrar of Industrial Property on the one hand, and the owners of industrial property on the other hand, as these disputes are related to the administrative work done by the Registrar when issuing decisions related to the same matter and affecting their legal positions.
The thesis aims to show that industrial property rights represent intellectual products that fall within the field of industrial activity, such as patents, industrial designs and models, designs for integrated circuits, and new plant varieties, as well as the commercial field, such as trademarks. The prevailing trend in jurisprudence believes that the set of these rights belongs to one right, which is industrial property.
