The University of Basrah, College of Law discussed A master's thesis about( international protection for a person who had a Handicap in international humanitarian law.
The thesis, which was presented by Um Al-Baneen Saad Mansour, highlighted the role of the international community and its long-standing concern for the rights and freedoms of individuals within their social, economic, political, and other contexts within the country they reside in. This concern extends to situations where an individual's physical or mental capabilities may be impaired due to various reasons, including genetic, medical, social factors, or armed conflicts, among others, leading to Handicap. This, in turn, results in a growing and substantial population of persons with Handicap who require international protection.
The thesis objectives are to draw the international community's attention to the rights of persons with Handicap through the issuance of several international instruments, such as the Convention on the Rights of the Child in 1989, the International Declaration on the Rights of Handicap Persons in 1975, the Declaration on the Rights of Mentally Retarded Persons in 1971, and unified rules on equal opportunities, among other international sources of protection for this category. Despite the United Nations regulating numerous international instruments related to human rights and freedoms in general and the rights of persons with disabilities in particular, it was not until 2006 that a specific international convention on their rights was established when the General Assembly issued the United Nations Convention on the Rights of Persons with Handicap in 2006, which culminated in all international efforts in this field.
