University of Basrah Organizes Workshop on Ignorance of Applicable Foreign Law
The College of Law at the University of Basrah organized a workshop on the plea of ignorance of applicable foreign law.
The workshop aimed to introduce the jurisprudential position on the plea of ignorance of applicable foreign law in the issue of legal capacity as a means of excluding foreign law.
The workshop included lectures delivered by Najat Abdul-Moneim Marzouq, a lecturer at the college. She explained that most countries' legislators were influenced by the ruling of the French Court of Cassation in the Lizardi case and the application of the judge's rule. This plea was adopted by Iraqi legislators in Article 18/2 of the Iraqi Civil Code, which stipulates that in financial transactions concluded in Iraq and resulting in their effects, if one of the parties is a foreigner with limited legal capacity and the reason for the limited legal capacity is due to a hidden cause that is not easily understood by the other party, then the foreigner is considered to have full legal capacity in this extreme.
