Master’s Thesis at the University of Basrah Explores Cognitive Imbalance in Consumer Contracts
A master’s thesis at the College of Law, University of Basrah, examined the issue of cognitive imbalance in consumer contracts during the implementation phase.
The thesis, presented by graduate student Saba Ali Dawood, aims to define the concept of cognitive imbalance between the parties of consumer contractual relationships at the execution stage, which arises from the inequality in the parties’ knowledge and awareness of the data and information relevant to contract performance.
The thesis consists of two chapters in which the researcher discussed the legal foundations of cognitive imbalance and the legal mechanisms to restore it, in order to ensure contractual balance in performance obligations amid the shortcomings of current legislation.
