Master’s Thesis at the University of Basrah Examines the Principle of Self-Sufficiency in Investment Contracts
A master’s thesis at the College of Law, University of Basrah, examined “The Principle of Self-Sufficiency in International Investment Contracts: A Comparative Study.”
The thesis, presented by student Haider Abdulhussein, aimed to determine whether the principle of self-sufficiency could constitute an independent legal basis for governing an international investment contract through its own terms and provisions, independently of national laws.
The thesis comprised two chapters. The first discussed the general framework of the principle of self-sufficiency in international investment contracts, including the concept of the principle, its legal basis, and scope of application. The second examined the manifestations of the principle of self-sufficiency and their impact on regulating the relationship between the investor and the host state, as well as their implications for contract performance and for determining the applicable law and governing rules.
