University of Basrah Master’s Thesis Examines Tort Liability Arising from Frustration
A Master’s thesis at the College of Law, University of Basrah, examined tort liability arising from frustration.
The thesis, presented by student Shuaa Munkhi Jabr, aimed to explore the extent to which the traditional general rules of tort liability may be inadequate to address the specific nature of acts of frustration.
The thesis comprised two chapters, in which the researcher discussed the conceptual foundations of frustration, including its concept and definition, its constituent elements, and the legal and religious basis for prohibiting frustration as established in the Qur’an and the Prophetic Sunnah.
