The academic at Faculty of law at university of basrah Dr. Tayseer Ahmed Abel participated in the tagged seminar (Fatima Al-Zahraa peace be upon her and the role of women in changing reality) which held by imam hussain holy shrine.
The participation included a discussion on the definition of personal status law, which is the set of legal rules that regulate the relationship of individuals to each other in terms of the relationship of descent, birth, jurisdiction, custody, rights and reciprocal duties, and the consequent disintegration resulting in rights to maintenance, custody, the other side of Jurisprudence the the five islamic doctrine put together provisions for women in the protection force of each and every misinterpretation of the provisions of the Shari’s, in this applied for come in Quran and Al Sunnah of regarding it whatever it is mother, daughter and wife, The jurists did not leave the matter with the passage the time, without solves taking considering when give the rule\ fatwa the changing of the place and time in the each society because these variables and remains the original Quran and Sunnah.
With this protection of women who distinguish the rules of the jurists of their own, each jurist was identified with a rule associated with his name for the absence of the other doctrines thereof, For example, in the Hanafi jurisprudence that the wife has the right to be infallible in her own hands as well as the man whether she wanted it, and this means that she can terminate the marriage contract by divorce herself whenever she wishes. As for Hanbali jurisprudence, women have the right to set conditions in marriage contract, Article 4 of the Iraqi Personal Status Law, she can stipulate that she should not marry her, stay in her house, replace her and not remove her from her, not travel outside her country.
The jurisprudence of al-Jaafari characterized the rules of inheritance, such as Girls or daughters inherit all the inheritance if they do not have a brother.
In Jaafari jurisprudence, the rules of inheritance are not only in the interest of women, but there are many rules in which their doctrines has been singled out alone or shared by one of the four doctrines.
In dowry: In the Jaafari doctrine, the deferred dowry is regarded as a debt in the husband's custody, therefore the women can claim it at any time. In the Sunni sects, the wife is entitled to a deferred dowry by the nearest two terms: the death or divorce of the husband, as well as in work, inheritance and custody.
